Our Terms and Conditions of Service Hire
Clause 1 - Booking
1.1 - Your booking is only deemed confirmed once we have received your service hire contract and a 25% booking fee of your invoiced amount, therefore, DJ Krazy Entertainment Bath (herein "DJ Krazy") will be unable to secure your date(s) until these have been received. The booking fee will be deducted from the total amount and is non-refundable.
1.2 - Payments must be made by Cheque, BACS, Cash or our Online Transaction Platform. All Payments must be submitted within 30 days after services have been completed. (See Clause x.x)
1.3 - For business bookings, DJ Krazy reserves the right to request a Purchase Order of the full amount from your finance department to ensure financial stability since they may need to start planning, booking, or hiring sub-contractors or other equipment well in advance to ensure your event can be carried out on the date you have provided. The Business will still need to provide the stated booking fee above to secure their date and to enable preparation.
Clause 2 - Requirements
2.1 - DJ Krazy requires a minimum of 60 minutes of access before and after the event to set up and break down equipment and ensure equipment is working correctly without faults. If your event requires unusual requirements such as outdoor lighting, the required access times will be listed on either your Job Specification or Quote/Invoice.
2.2 - An approximate space of 4m by 3m deep to accommodate the DJ set as well as providing a minimum of 4x 240-volt 13 amp outlets from a reliable power source within 3 meters. DJ Krazy will liaise with you to ensure space and higher power infrastructure, it is their responsibility to follow up with you privately and ensure the infrastructure is present.
2.3 - If DJ Krazy and/or his team is required to work alongside a band, it is your responsibility to ensure your room plan provides sufficient space and power requirements for both entertainers.
2.35 - Please let us know if you have booked a band and provide us with a way of contact so we can follow up privately with them to discuss set lists and other internal requirements. This will then allow us to build a professional relationship between them and ensure your event runs smoothly.
2.4 - DJ Krazy Entertainment may request a site visit, if we do, all we require is the name and contact number of your event manager at the venue so we can arrange when it is convenient for us, it is your choice whether you'd like to attend. This is to visualise space and to see pre-installed equipment such as sound limiters. Sound Limiters, installed by the venue where they disconnect supply to nearby sockets should the volume be high, can be a problem when it comes to sensitive equipment and it is DJ Krazy's responsibility to protect such equipment.
2.5 - Should you wish to give us a music request sheet, please ensure this is given to us within a minimum of two weeks before the date of your event. This sheet will be used to influence our set and will not be strictly followed as we will read your crowd's movements. If we do not receive a list of your chosen music, we will endeavour to play around the genre stated and consistently review the crowd's behaviour towards the playing records and change the music if we deem it is correct to do so. We will try to source and play your and your guest's requests where possible but we will never be obligated to play any certain track. If you wish to discuss this further with us, you are more than welcome to.
Clause 3 - Our Commitments
3.1 - DJ Krazy commits to you that he and his team will arrive at the venue arrival time stated within this contract to ensure that he can be ready to perform at the start time of the the event, which also is stated within this contract. DJ Krazy cannot be held liable for any type of refund or discount should he or his team become unable to access the venue because of factors which include but are not limited to; Late access, where the venue is locked and/or earlier events overrun, or venue management denying access. We also are not obligated to provide a time - extension to the agreed timescale, although we will endeavour to
3.2 - The performance fee is in no way affected by inclement weather and we will try to continue your booking as best as we can, however, if your event is an outdoor performance, it is your responsibility to ensure there is sufficient shelter for the setup area. We will always reserve the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. The performance fee will not be affected by such cancellation.
3.3 - We will try our utmost to build our set mix around your genre of music however we may need to change our set during the event to ensure all tastes of music are catered for as we aim to perform for your crowd.
Clause 4 - Our Expectations From You
4.1 - You will be responsible for providing adequate supervision of your guests and ensuring that venue management will supervise their staff on its site premises. If you are expecting guests who are under the age of 18 years old, it is your responsibility to ensure either their parents are present or you hold responsibility for their behaviour and safety. We will not hold any liability for supervising any minors but will ensure safety is paramount and enforced to reduce possible harm.
4.2 - If damages or injuries to DJ Krazy's staff or property are deemed to be caused by gross negligence on your part, you will be liable for the cost to either repair or replace the selected equipment or medical fees.
4.3 - You will be responsible for paying any charges imposed by the venue. These charges may include but are not limited to, the use of electric power, fire marshal (for use of fog), and overtime before and after the engagement utilized by DJ Krazyfor setting up and taking down equipment.
Clause 5 - Damages and Repair Costs
5.1 - Continuing from clause 4.2, there is no maximum amount for equipment or injury costs. An investigation will occur internally and may involve external investigators such as law enforcement or insurers if we deem it necessary to establish the party('s) at fault. If both parties are deemed at fault - DJ Krazy will ensure to agree to either discuss and come to a fair settlement or discount on the total amount.
5.2 - If DJ Krazy deems it necessary to charge you for damage caused, the costs will include an admin charge of £35 as well as labour costs of £95 an hour for each repair on top of the total cost of replacement parts.
5.3 - Should third-party equipment be involved and become damaged - the equipment is subject to the same conditions as 5.2.
Clause 6 - Sub - Hired Equipment
6.1 - If your event requires sub-hired equipment from an external supplier, It is DJ Krazy's responsibility to ensure compatibility and specification are suited to the elements of the event.
6.2 - You are to provide an agreement in writing before any external job is confirmed. If an agreement is not provided, DJ Krazy will not continue with the quote from the external company/ies and will make best efforts to ensure the event can be done with the equipment already at hand.
6.3 - Costs for such equipment will be firstly invoiced and settled by DJ Krazy but will be included in your invoice where you will be expected to settle. Should costs be incurred when equipment is returned, DJ Krazy holds limited responsibility.
Clause 7 - Health and Safety
7.1 - DJ Krazy Entertainment will ensure that an Equipment and Public Liability Policy stands before and during your event. Public Liability is expected to have a minimum of 5 million pounds and ensure their equipment is up to electrical safety and standards. This usually is proven by a Portable Appliance Testing results sheet. Equipment Insurance must cover third parties as well as their own and the claimable amount should be sufficient enough to cover the total insurance amount of equipment expected on site.
7.2 - DJ Krazy has a responsibility to ensure guests know at the entry of the venue that unconsiderable sound levels and flashing light effects are present in the venue. They will ensure that ear protection is available for guests if the volume of the room is over 90db as well as reduce flashing light changes by using lighting systems involving the protocol of DMX. Notices should also be present to show per HSE guidance.
7.3 - DJ Krazy Entertainment reserves the right to cease performance if any of their staff feel in danger of a present threat or have a census of an implied threat. DJ Krazy will provide a maximum of 30 minutes to de-escalate the situation and giving best efforts to resume performance. Should resuming be not appropriate, the full balance will still be payable with no obligation from DJ Krazy to provide a refund or discount. If the event can be resumed, then the terms above will continue to stay enforced however time lost will not be added on at the end of the contracted hours.
7.4 - DJ Krazy Entertainment will restrict access behind the DJ Booth allowing them to ensure the safety of equipment and personnel. If any guests are found to be behind the DJ Booth when permission is not given - DJ Krazy will not be liable for any injuries caused and any damage will be immediately invoiced to you.
Clause 8 - General
8.1 - This agreement can only be cancelled if submitted in writing to DJ Krazy who will provide mutual correspondence if appropriate. Should cancellation be initiated by you, you will be subject to the cancellation terms shown on your invoice. If none are present, the minimum fee will be 10% with up to the full total of the invoice being due. DJ Krazy will ensure professionalism and honesty and only invoice the appropriate charges that need to be covered by you. If your event incurs charges from sub-contractors or other external planning such as third-party equipment, we will require a minimum of 14 days so we can reduce these charges to you. We still cannot guarantee that you will not be charged the full or partial amount of these fees.
8.2 - DJ Krazy Entertainment understands unfortunate circumstances occur such as death which may prevent the event from going ahead. In these circumstances, they will request proof of the circumstance e.g.; a Death Certificate which will then enable both parties to negotiate a financial sub-contract, a contract which is a substitute to all financial clauses within the original contract, outside of these terms. This must be given to all parties and filed against the original contract.
8.3 - This agreement is not binding until received and signed by a staff member of DJ Krazy Entertainment Any changes must be written and signed by both parties. Oral agreements are non-binding. If any clause in this agreement is found to be illegal, the rest of the agreement shall remain in force.
8.4 - This agreement for DJ Krazy to perform shall be excused by detention of personnel by sickness, accidents, riots, strikes, epidemics, acts of God, Force Majure or any other legitimate condition beyond their control. If such circumstances arise, all reasonable efforts will be made by them to find a replacement entertainment at the agreed-upon fees. Should they be unable to procure a replacement, You will be provided with a DIY system which will be dropped off and collected at stated times with a pre-mixed set of classics to modern music with also the capability for you to be able to connect your device simply. You will also receive a full refund of all fees paid. You will agree that in all circumstances, DJ Krazy cannot be held liable and shall be exclusively limited to refunding the fees paid and that they shall not be liable for indirect or consequential damages arising from any breach of contract.
8.5 -Enlightened Lighting Ltd, which is a separate entity to us, is our well-trusted third-party company and any sub-hired equipment or DIY packages will mostly be provided by them. In the circumstance that our staff is unable to attend limited to clause 8.4, the equipment will become your responsibility and you will be liable to their terms and conditions. If this is the case, we will give you our best efforts to help you get equipment insurance in place. Our Insurance will not be valid unless we are in attendance.
8.6- This agreement will be covered by the laws and courts of England.
8.7- This agreement cannot be transferred to another party. A new one must be submitted in the other party's name. You may request this by contacting us.
